These conditions are concluded exclusively between the company SARL ADS SPORT, whose head office is located at Cité 260 logs lotissement Bouda division 71 N 85 Bordj Bou Arréridj, Algeria. (hereinafter referred to as “ADS SPORT”) and any person visiting, making a purchase or making a reservation (hereinafter referred to as “the Internet User”) via the site accessible at the address www.adssport.dz (hereinafter referred to as “the Site”).
ADS SPORT and the Internet User will hereinafter be collectively referred to as “the Parties”.
The Parties agree that their relations will be governed exclusively by these general conditions of sale which are accessible on the Site.
These conditions may be subject to change. Therefore, it is understood that the applicable conditions are those in force on the site at the time of registration of the customer’s order.
The date of posting of these general conditions of sale online is the effective date (July 1, 2024).
Article 1 – Contract
The Internet user declares that he or she is 18 years old and has the legal capacity to enter into a contract on the Site or that he or she holds parental authorization allowing him or her to place an order. The Internet user also declares that he has read and agrees to comply with these General Conditions of Sale.
In order to place an order, the Internet user must first create an account on the Site by providing information including their name, postal and telephone contact details and email address, or use their loyalty account identifiers. This account will also allow him to track his order.
Article 2 – Products
ADS SPORT strives to describe and present the items sold on the Site with the greatest accuracy. However, certain characteristics of the products may be slightly modified, in particular to improve their quality.
ADS SPORT cannot be held responsible for any error of judgment linked to the use of the Internet network. In view of this method of communication, it is possible that the product as displayed on the Internet user’s screen differs slightly (in particular in color) from the product ordered.
Article 3 – Prices
The prices displayed on the Site are indicated in Algerian dinars and with all taxes included and applicable in Algeria. VAT is applied at the rate in effect at the time of ordering. Any change in rate will be immediately reflected in the price displayed on the Site, but the rate applicable to your order will be the one in effect at the time of validation of the order.
Product prices are exclusive of shipping costs, the price of certain packaging or the price of other optional services subscribed to by the Internet user. These will be brought to the attention of the Internet user on the summary screen before final validation of the order.
During certain promotional operations, the prices practiced on the Site may be different from the prices practiced in the ADS SPORT ALGER, BBA and ORAN stores. Unless otherwise stated, the prices displayed relate exclusively to products purchased online on the Site.
Article 4 – availability
The Site is intended to present for purchase and online reservation of sports items, shoes and accessories related to sport and lifestyle. The items visible on the Site are available while stocks last in ADS SPORT warehouses.
In the event of a registered order for a product or item that becomes unavailable, ADS SPORT undertakes to inform the Internet user as soon as possible and not to invoice the Internet user.
Finally, the Internet user is informed that certain products, specifically identified on the Site, are only available in the network of stores under the ADS SPORT brand and that the assortment of these products may vary from one store to another.
Article 5 – payment
The Internet user can pay for their purchases in cash and in Algerian dinars when they receive their package at their place of residence or work, delivered by one of our approved delivery service providers.
The Internet user can also make payment by bank card directly on the Site interface.
Article 6 – home delivery
Home delivery service is available in 48 wilayas. The delivery times announced on the Site are calculated in working days, from the exit from the ADS SPORT warehouses of the products ordered by the Internet user, taking into account the order dispatch time to which is added the carrier’s delivery time.
Article 7 – Reimbursement conditions
Only orders that meet the conditions stipulated in Article 23 of Law No. 18-05 of 24 Chaâbane 1439 corresponding to May 10, 2018 relating to electronic commerce will be refunded.
ADS SPORT will take back its merchandise, in the event of delivery of an item not conforming to the order or in the case of a defective product.
The customer must return the goods in their original packaging, within a maximum of three (3) days from the effective delivery date, indicating the reason for refusal, the costs being borne by ADS SPORT.
ADS SPORT is required to:
— a new delivery in accordance with the order, or
— repair of the defective product, or
— an exchange of the product for an identical one, or
— cancellation of the order and reimbursement of the sums paid, without prejudice to the possibility of a request for compensation by the e-consumer, in the event of damage suffered.
Reimbursement will be made within fifteen (15) days from the date of receipt of the product.
Article 8 – exchange and return
In the event that the size of a product does not suit the Internet user, the latter has a period of 03 days from receipt of the product to request an exchange from ADS SPORT. This request must be made directly by telephone to the number indicated on the site, by contacting customer service via telephone, instant messaging or by e-mail.
Furthermore, any product that has been used by the Internet user after being delivered cannot be returned, exchanged or refunded.
Finally, any order made during the sales or promotional period is not affected by the condition relating to reimbursement. Only exchanges.
Article 9 – Orders
Any order on the Site implies express and unreserved acceptance of these general conditions of sale.
Any order placement requires the creation of a customer account or connection with a Facebook account. Once the account has been created, access to the “Customer Area” is conditional on the identification of the Internet user using the email address provided when creating the account as well as the secret and personal password chosen. ADS SPORT Algérie cannot be held responsible for any action carried out on the “Customer Area” by a third party to whom the Internet user has communicated their identifiers or who has had access to the account following negligence on the part of the Internet user.
Article 10 – personal data
The data collected from the Internet user is subject to computerized processing by the company SARL ADS SPORT, whose head office is located at Cité 260 logs lotissement Bouda division 71 N 85 Bordj Bou Arréridj, Algeria as data controller.
The data collected is reserved for use by the Marketing Department of SARL ADS SPORT, acting as a subcontractor. And which will be the subject of market studies, intended to improve the quality of service of ADS SPORT.
The personal information collected is necessary for processing the order, its delivery, the establishment of the invoice, and the matching of customer data with that of the Facebook company.
Article 11 – Responsibilities
ADS SPORT cannot be held liable in the event of a breach of one of its contractual obligations if this is due to a case of force majeure as defined by Algerian case law or to the unforeseeable and insurmountable act of a third party to the contract.
Under no circumstances may ADS SPORT be held liable for loss of profits, commercial losses, loss of data or loss of earnings or any other indirect damage or damage that was not foreseeable at the time of use of the Site or the conclusion of the sales contract between the Parties.
The ADS SPORT brand cannot be held responsible for any direct or indirect damage that may be suffered by the Internet user due to the use of the Internet network.
Article 12 – Site access license
ADS SPORT grants a limited license to access and use the Site for the Internet user’s personal use. Under no circumstances does this confer the right for the Internet user to download or modify all or part of the site without the express authorization of ADS SPORT.

ADS SPORT undertakes to systematically inform the Internet user of the rejection of a review as well as the reason for the rejection. ADS SPORT also undertakes to give the Internet user the opportunity to submit a new opinion for moderation. ADS SPORT is not required to specify the reasons for rejecting a review that has been identified as aiming to artificially construct or bias the evaluation of the product or service.
Article 15 – entirety
These General Conditions of Sale are made up of all the clauses that compose them. The fact that ADS SPORT does not assert at any given time any of the clauses herein cannot be considered a waiver of the right to assert these same clauses at a later date.
In the event of invalidity of one of them, the other clauses remain valid.
Article 16 – Applicable law
These general conditions of sale are subject to Algerian law.
